(2) Unless expressly agreed otherwise, the inclusion of the customer’s own terms and conditions is rejected.

(3) A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

(4) An entrepreneur within the meaning of these Terms and Conditions is any natural or legal person, or a partnership with legal capacity, who or which enters into a legal transaction in the exercise of their independent professional or commercial activity.

§ 2 Subject Matter of the Contract

(1) The subject matter of the contract is the sale of digital products. These include, in particular, software, plugins, themes, add-ons, digital tools, digital files, documentation and other digital content provided in digital form.

(2) No physical delivery takes place. Provision is made digitally, in particular by download, download link, provision in a customer area or another electronic access option.

(3) The essential characteristics of the respective digital product are set out in the corresponding product description on our website.

§ 3 Conclusion of the Contract via the Online Shop

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) You can place a digital product in the shopping cart and complete the order process via the checkout. Before submitting the order, you can review and correct your entries.

(3) By clicking the final order button, you submit a binding offer to conclude a contract for the digital products contained in the shopping cart.

(4) The contract is concluded when we accept your order. Acceptance may take place, in particular, by order confirmation by e-mail, by payment confirmation, by activation of the download or by provision of the digital product.

(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract usually take place by e-mail and partly in an automated manner. You must ensure that the e-mail address provided by you is correct, that receipt of the e-mails is technically ensured and, in particular, that receipt is not prevented by spam filters.

(6) A customer account is not required for the purchase, unless otherwise stated in the respective order process.

§ 4 Contract Language and Storage of the Contract Text

(1) The contract language is German.

(2) If English translations of legal texts, product information or other information are provided, they serve the purpose of better understanding. In case of doubt, the German version shall prevail, unless expressly agreed otherwise.

(3) The complete contract text is not permanently stored by us as an individually retrievable contract text. Before submitting the order, you can print the contract data using your browser’s print function or save it electronically.

(4) After receipt of your order, you will usually receive the order data, these Terms and Conditions and the legally required information again by e-mail.

§ 5 Prices and Payment Terms

(1) The prices stated on the website are total prices. They include all price components, including any applicable statutory taxes, insofar as such taxes apply.

(2) There are no shipping costs, as provision is made exclusively in digital form.

(3) The payment methods offered in the respective order process are displayed to you in the checkout.

(4) Unless otherwise stated in the respective offer or in the checkout, the purchase price is due for payment immediately.

(5) If payment is made from a country outside the European Union or via an account outside the European Union, additional costs may arise for which we are not responsible, such as bank fees, exchange rate fees or comparable costs. These costs must be borne by you.

§ 6 Payment Service Providers

(1) Payment via PayPal / PayPal Checkout

§ 7 Provision of Digital Products

(1) The digital product is provided after successful completion of the order and, where advance payment or an online payment method has been agreed, after successful payment confirmation.

(2) Provision may take place, in particular, by download link, download page, e-mail with access information or another electronic access option.

(3) You are responsible for downloading the provided digital product after receipt, storing it properly and creating appropriate backup copies for your own use, insofar as this is permitted under the respective license terms.

(4) A claim to permanent renewed provision of a download link exists only insofar as this is required by law or expressly promised in the respective offer. Statutory rights remain unaffected.

§ 8 Rights of Use and Software License

(1) The digital products offered are protected by copyright and, where applicable, by further intellectual property rights.

(2) Upon full payment of the purchase price, you receive a simple, non-exclusive, perpetual right of use for the purchased digital product in accordance with these Terms and Conditions, the respective product description and the separate Software License and Terms of Use.

(3) Unless otherwise stated in the respective offer or in the separate Software License and Terms of Use, you may use the purchased digital product for your own private or business purposes.

(4) You do not acquire ownership of the software, the source code, the design, trademarks, names, concepts or other intellectual property rights. All rights not expressly granted remain with the provider or the respective rights holders.

(5) Without the express consent of the provider, it is in particular not permitted to resell, rent, lease, give away, make publicly accessible, upload to file-sharing platforms, sublicense or otherwise transfer digital products or essential parts thereof to third parties.

(6) For software, the separate Software License and Terms of Use apply in addition. These are linked during the order process and must be accepted before the order is completed.

§ 9 System Requirements, Compatibility and Third-Party Software

(1) The required or recommended system requirements for the respective digital product are set out in the respective product description, documentation or other information on the product page.

(2) You are responsible for checking before purchase whether the digital product is suitable for your technical environment.

(3) Compatibility with future versions of operating systems, programs, platforms, WordPress, Easy Digital Downloads, Blender, browsers, plugins, themes, payment services or other third-party software is owed only if expressly promised.

(4) Where digital products work together with third-party software, platforms or external services, the respective providers’ own terms may apply to such third-party offerings.

§ 10 Updates and Further Development

(1) Updates, bug fixes or new versions are owed only insofar as this is required by law or expressly promised in the respective offer.

(2) Unless expressly agreed otherwise, no specific new functions, extensions, design changes, permanent further development or compatibility with future changes to third-party software are owed.

(3) The provider is entitled to further develop digital products, modify, rename, supplement or discontinue functions, provided that this does not impermissibly impair the customer’s statutory rights.

§ 11 Right of Withdrawal

(1) Consumers generally have a statutory right of withdrawal.

(2) Further information on the right of withdrawal, its requirements, deadlines, consequences and, where applicable, the expiry of the right of withdrawal for digital content can be found in the separate withdrawal instructions.

§ 12 Warranty for Digital Products

(1) The statutory rights relating to defects apply.

(2) The statutory provisions regarding the conformity of digital products apply to digital products.

(3) If a digital product deviates from objective requirements, such deviation shall be deemed agreed with consumers only if the consumer was specifically informed of this before submitting their contractual declaration and the deviation was expressly and separately agreed.

(4) Suitability for a specific purpose intended by the customer is owed only if such suitability has been expressly agreed or expressly promised in the respective offer.

§ 13 Liability

(1) We are liable without limitation in cases of intent and gross negligence, in the event of injury to life, body or health, and in all cases in which liability is mandatory by law.

(2) In the event of a slightly negligent breach of essential contractual obligations, we are liable only for the typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely.

(3) In all other respects, liability is excluded to the extent permitted by law.

(4) The above liability provisions also apply in favour of our legal representatives, employees, vicarious agents and other persons acting on our behalf.

§ 14 Right of Retention

You may exercise a right of retention only insofar as it concerns claims arising from the same contractual relationship.

§ 15 Choice of Law

(1) The law of the Federal Republic of Germany applies.

(2) For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall not apply.

§ 16 Final Provisions

(1) If individual provisions of these Terms and Conditions are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
